Abstracts of Lancaster County, Virginia Wills - 1653-1800 Newby, Henry died with out making a will. Rec 21 May 1764. Mary Newby widow applies for certificate of administration Will Book 17 page 32. Look to see who paid the bond for this . I believe that there may be a clue there , possibly a father or brother. Have you checked Deed records for Lancaster County for this time frame1730 –65 NO!. Perhaps the Henry who died 1741 named his son Henry. Did Henry d 1741 leave all his land to Henry his son. If this is true then that explains why Mary Tomlin Newby would have left him out of her will. The problem here as I see it is there is a father and son named Henry who marr Mary s . I believe Henry b 1713 marr. Tomlin . Since the name Whaley appears in the sons names of these parents might it also be that this Henry was married 2 times the latter wife being named Whaley. Henry NEWBY was born about 1736 probably in Lancaster County, Virginia. Henry NEWBY married Elizabeth Betty ROGERS before 1758 probably in Prince William County, Virginia. Elizabeth was born About 1738 probably in Prince William County, Virginia. Doct’r Richard HALL charged him rent. The widow NEWBY was paying the rent with the assistance of George ROGERS Senior in 1781. Soon after Henry NEWBY died in 1782 in Fauquier County, Virginia some of the family moved to Bullitt County, Kentucky. It seems that Henry died in early 1782 and perhaps his rent was due only every 2 years. His widow, Betty Newby, is found only once in the Per. Prop tax list for Fauquier: in 1782 when she was taxed on Horses and cattle only. Betty was summoned to Court in 1784 to administer her husband’s estate. A Betsy NEWBY is living in the 1810 Census of Bullitt County, Kentucky a widow with three children. Is this our Elizabeth? See note below , her daughter Betsy Sanders is found in Bullitt KY. Nancy NEWBY was born about 1760 married William BAILEY 11 Feb 1782 in Fauquier County, Virginia William born 1757 Prince William d 28 Jun 1832 Culpeper County VA married Nancy was alive 1743 in Culpeper County, Virginia. This William is the one found in the American Revolution. He enlisted 1776 served at battles Brandywine and Germantown as well as wintering in Valley Forge. He served the latter part of his 3 year enlistment at Fort Pitt. He served in Simon Morgan’s Co under Capt Russell NOTE: The 2 oldest daughters of Henry and Betty were evidently over 21 when they married since there is no consent with their marriage 2c. Robert GIBSON witnessed the will of George Rogers in 1792. We do see a notation in 1790 when Sinah married Robert Gibson(interesting notation here in 1788 tax list for Fauquier Robert Gibson is found in the home of George Rogers, Jr. who paid his tax for that year only) that she was the daughter of Betty NOTE: Gabriel SANDERS and Thomas SANDERS were the sons of the Rev Robert SANDERS and Ann NASH NOTE: There were Newbys living in close proximity if not in Fauquier as early as 1767 There is also a reference in deed books that Oswald was a Witness to a deed in 1767, we also note that Whaley Newby had assigned something of Value to William Allason in 1767. They were slave owners , at times owning as many as 6 slaves. Tax records also indicate that considering the amount of land that Wm owned he owned as many as 12 horses. During his later years he fell upon difficult times where he often ended up in jail By his later years he had mortgaged his land to such a degree that he lost it . He and Nancy spent their last years in the home of their son Presley in Culpeper County VA. Nancy is found there in the 1843 Federal census of pensioners 3a. Fauquier County 1759-1959 page 215 TheRed Store – 334 Main Street, Warrenton The building known as The Red Store was established as a trading post by Alexander Cunninghame of Falmouth prior to 1764, and was more or less in the center of town when it was surveyed in 1790. This small building consisted of one room up and one room down, and was originally locaed slightly north of Main Street between Third and Fourth Streets to the rear of there the theatre and fire house now stand. At what date and when The Red Store was moved is not known, but is was transferred to the site of the Pretlow hose at Main and Calhoun Streets. Dear Mr. Kennann: I am enjoying reading the book you recently sent me—William Newby: A Civil War Soldier's Return. Thank you for your note. I'd like to comment on two things: genealogy and the nature of William Newby's ailments. Genealogy Yes, I believe I am related to that branch of the Newby Family. I have enclosed some pages of genealogy that runs from sometime in the 17th century in Virginia, and indicates the probable link. (If your interests include this sort of thing, I can copy and send you the entire tale, about 75-80 pages for the cost of copying it, about $15.) My great great grandfather was named Whaley Newby. Whaley's father was a Henry Newby who died in Virginia in 1741. I believe that this Henry Newby was the great great grandfather of William Newby who was struck down at the battle of Shiloh. Whaley Newby is an unusual name. He was the first to bear it: his given name was his mother's maiden name, Mary Whaley (born c. 1721 in Lancaster County, Va., died in Tennessee in 1796. Whaley had a youngest brother, William born about 1730 who died in Virginia in 1815. Of that Lancaster County, Virginia family, Whaley was the only Newby to move west to Tennessee and Kentucky. On page 199 and 200 of your book (see deposition sidebar), William Newby recites his family names. His brother Whaley, who served alongside him and his brother James at Shiloh, is described as "named after an uncle from Tennessee." The father of William (Shiloh) was named John. William (Shiloh) said his father's two brothers were Whaley and Hezekiah, so this would be the "uncle from Tennessee" for whom Whaley was named. It is obvious that Uncle Whaley had been named for his own grandfather, the first Whaley Newby, from Virginia. William (Shiloh) also stated that "I was named after my grandfather, who was William Newby." Whaley Newby of Virginia had several sons while he was on the trek west. They included my ancestor, Henry b. 1772 in Virginia, and a son William b. 1775. This William died in 1844 in Smith County, TN. I believe he was the father of a John Newby (b. c. 1800?) and named his other sons Whaley and Hezekiah. In turn, John became the father of the Whaley, James and William (B. 1825) of the Shiloh experience described in your book. However, William in speaking of his grandfather said that "I don't remember that I ever saw him." This seems strange because he would have been 19 at the time of his grandfather's death in 1844. Although I have outlined the probable link from William to the early Henry Newby (d. 1741), this isn't completely documented. Still, I am convinced that the unique name of his brother, Whaley Newby, and the presence of my ancestors in Tennessee and Kentucky at the beginning of the 19th century places us in the same branch of the family.
